10% Deposit and Contingencies: Securing Your Investment

After the buyer’s offer, along with all agreed-upon contingencies, has been accepted by the seller, our focus shifts to assist the buyer in selecting a reputable and certified property inspector in the area. The chosen home inspector conducts a comprehensive examination of the property. If the inspection reveals no major concerns and proves satisfactory to the buyer, we promptly notify the seller that the buyer will waive the inspection and proceed with the property purchase. At this stage, the buyer is required to provide a 10% deposit of the purchase price within 5 business days. This deposit serves as a substantial commitment, symbolizing that the property is now “UNDER CONTRACT,” effectively removing it from the market. The seller is no longer able to accept any additional offers on the property, even if they exceed the current offer in value.

Subsequently, Lake Chapala Realty transfers all necessary paperwork to the closing coordinator, who handles the due diligence process for the closing with meticulous care. Throughout this stage, our team remains steadfast in representing your best interests, ensuring a seamless closing process. It is important to emphasize that the seller will not receive the funds until the deed has been signed in the presence of the buyer’s chosen Notary. This prudent approach safeguards your investment and guarantees a secure transaction.

The Closing

In Mexico, the transfer of property, legal documentation, and Mexican deeds, better known as “Escritura” is overseen by certified Mexican Notaries appointed by the government. As a buyer, you have the freedom to choose the Notary you prefer.

We work directly with the Notary to facilitate a thorough examination of the property. The Notary’s responsibilities include reviewing the property’s history, obtaining certificates to confirm the absence of liens or debts from the public registry, verifying accurate measurements, and even requesting a no-debt certificate from the homeowners’ association (HOA) if the property is located in a gated community. In Mexico, the Notary assumes liability, eliminating the need for title insurance.

Clear and Transparent Closing Statements

Smooth Utility Bill Transfers

If the seller employs individuals such as maids or gardeners, we obtain severance letters to provide you with peace of mind. These letters confirm that the previous staff members have received their entitlements, ensuring you are not held liable for any future severance payments.

HOA Compliance

For properties within an HOA, we communicate with the board to obtain a no-debt letter required for closing. This letter assures you that the seller has settled all outstanding dues associated with the property, offering reassurance and a smooth transition of ownership.

Diligent Deed Verification

During the closing process, we meticulously review and verify the accuracy of the deed’s information before all parties sign it. This thorough examination ensures that all essential details are correct. Once the deed is signed, we release the funds to the seller, completing the transaction.
